General Terms and Conditions of Sale

Preamble

The Q:tee online store (q-tee.fr) (hereinafter referred to as the "Site") is an e-commerce website accessible via the Internet, open to any user of this network (hereinafter referred to as "User"). It is published by the company ATEMP POUR ELLE, whose registered office is located at 25 Rue Pierre Curie 83120 SAINTE MAXIME, registered with the Trade and Companies Register under number 800 797 458. The Site allows the Q:tee brand to offer for sale textile products and accessories under the Q:tee brand or its potential commercial partners (hereinafter referred to as the "Products") to Users browsing the Site (hereinafter referred to as "Clients") within the sales area indicated in Article 2. For the application of these terms, it is agreed that the Client and ATEMP POUR ELLE will be collectively referred to as the "Parties" and individually as a "Party," and that the Client who has validated an order will then be referred to as the "Buyer." Any order of a Product offered on the Site implies the Buyer's adherence to these general terms and conditions of sale. The general terms and conditions of sale are those in effect on the date of the order placement.

Article 1 - Purpose

These general terms and conditions of sale govern the rights and obligations of the Parties resulting from the online sale of Products offered on the Site, to the exclusion of any other document.

Article 2 - Products – Prices

2.1. Products

Only the Products listed on the Site on the day of its consultation by the Client are offered for sale. The product offers are limited to Metropolitan France, European Union member countries, as well as Switzerland and Norway. The product offers and prices are valid, subject to availability, as long as they are visible on the site. The photographs presenting the products on the site are non-contractual.

2.2. Prices

We strive to ensure that the information, descriptions, and prices are accurate; however, errors may occur. If the price of an item you ordered is incorrect, we will inform you as soon as possible, and you will have the option to confirm your order at the correct price or cancel it. If we are unable to contact you, we will cancel the order. Prices are indicated in Euros, including all taxes. The Value Added Tax is the current rate in France. If you reside outside the European Union, you are entitled to a VAT exemption of 20% in France. In this case, the shipping address must be outside the European Community. The final invoice will reflect this tax exemption. We remind you that shipments outside the European Union are subject to import taxes and customs fees (delivered DDU, duties unpaid) based on the regulations of your country of origin.

The flat-rate participation in preparation and delivery costs will be communicated to the Client on the order summary page before the final validation of the order.

Article 3 - Order

3.1. Order Registration

The Client who wishes to place an order selects the different Products of their choice by clicking on "Add to Cart." At any time, the Client can:

  • Check the number of Products in their cart and obtain detailed information on each of them by clicking on "Cart."
  • Continue selecting Products by clicking on the "Continue" button.
  • Complete their order by clicking on the "Checkout" button.

Any new Client must fill in the fields provided to create their customer account. The Client must accurately complete the form available to them, including the necessary information for their identification, such as their email address and a chosen password (which will be personal and confidential) to be used for future identification on the site. Any Client already holding a customer account must identify themselves after clicking on "Finalize Order," by entering their email address and password. The Client agrees that the entry of these two identifiers serves as proof of their identity. The provision of personal information collected in the context of distance selling is mandatory; this information is necessary for the processing and delivery of orders and the establishment of invoices. This information is strictly confidential.

After reviewing their order, and once all requested information has been completed by the Client, they acknowledge the General Terms and Conditions of Sale by checking the box provided for this purpose.

3.2. Order Validation

The validation of the cart confirmation constitutes an electronic signature. This signature has the same value between the Parties as a handwritten signature and serves as proof of the entire order and the enforceability of the sums due in execution of said order. As soon as the Client validates their order, they become the Buyer. Notwithstanding the application of Article R624-3 of the Penal Code, the Client will pay for their order by credit card (Visa, MasterCard, American Express) or via the secure PAYPAL payment system. If the Client wishes to pay for their order by credit card, they must provide their credit card number, the card's expiration date, and the security code.

3.3. Payment

The amount due by the Buyer is the amount indicated on the order summary document. In any case, the amount debited will correspond to the Product(s) actually delivered.

3.4. Order Acknowledgement

Upon payment completion, an order summary document is sent to the Buyer by email to the email address provided. This document, serving as an order confirmation, includes all elements constituting the contract between the Parties.

Article 4 - Delivery

4.1. Principles

ATEMP POUR ELLE will do its best to ensure that the order is delivered within an average of 1 to 5 business days and a maximum of 15 working days from the day following the validation of the order by the Buyer. It is specified that orders placed on the Q:tee (q-tee.fr) website on Friday afternoon, Saturday, or Sunday are processed the following Monday. Orders placed on the website on a public holiday other than Friday, Saturday, and Sunday are also processed the next working day.

 

The products ordered by the Buyer are delivered to the address provided by the Buyer on the final validation page of their order, accompanied by a delivery note.

Article 5 - Order Reception

Upon receiving the order, the Buyer will check the conformity of the Products received in execution of their order. Any anomaly concerning the delivery (i.e., missing or damaged Products, damaged packages) must be notified within 14 days of receiving the Products.

IMPORTANT NOTE: ATEMP POUR ELLE reserves the right to request the Buyer to return the non-compliant or damaged Product. In case of abnormal or abusive returns, ATEMP POUR ELLE may refuse to fulfill a subsequent order.

Article 6 - Right of Withdrawal

The Buyer has a period of fourteen (14) working days from the date of receipt to return, at their expense, the Product(s) they ordered. The Product(s) must be returned in their original packaging and condition and in new condition. If the above conditions are met, ATEMP POUR ELLE will refund the Buyer the total amount of their order, within thirty (30) days from the receipt of the Products by ATEMP POUR ELLE, except for the return shipping costs, which are the responsibility of the Buyer.

For any return or exchange procedure (subject to stock availability), the Buyer must contact customer service by email at assistance@q-tee.fr.

Article 7 - Warranty

All our products benefit from the legal warranty regime, provided that the use has been normal and that the maintenance advice has been followed.

Article L211-4 of the Consumer Code

The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter has been placed under their responsibility by the contract or carried out under their responsibility.

Article L211-5 of the Consumer Code

To be in conformity with the contract, the goods must:

  1. Be suitable for the purpose usually expected of similar goods and, where applicable:
  • Correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
  • Present the qualities that a buyer may legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
  1. Or have the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the seller's knowledge and which the seller has accepted.

Article L211-12 of the Consumer Code

The action resulting from the lack of conformity lapses two years after the delivery of the goods.

Article 1641 of the Civil Code

The seller is bound by the warranty for hidden defects in the item sold that render it unfit for the use for which it was intended, or that so diminish this use that the buyer would not have acquired it, or would have given only a lesser price, had they known.

Article 1648, Paragraph 1 of the Civil Code

The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect.

Article 8 - Exchanges

Exchange requests must be made by email to assistance@q-tee.fr.

If at the time of the exchange request the Product(s) is (are) no longer available, ATEMP POUR ELLE agrees to a refund/store credit at the purchase price within thirty (30) days from the receipt of the Product(s) by ATEMP POUR ELLE.

Article 9 - Data Protection

9.1. Personal Information

Personal information is processed by ATEMP POUR ELLE for customer relationship management and prospecting purposes. To enable you to receive offers from our partners, we may share this information with them. In accordance with the Data Protection Act of January 6, 1978, as updated by the law of August 6, 2004, the Client has the right to access, rectify, and oppose the data concerning them.

9.2. Cookies

The Site uses cookies. A cookie is a computer file stored on the Client's hard drive. Its purpose is to indicate a previous visit by the Client to the Site. Cookies are only used by ATEMP POUR ELLE to personalize the service offered to the Client. The Client retains the possibility of refusing cookies by configuring their Internet browser.

9.3. Web Beacons

Certain web pages on the Site may contain web beacons that allow counting the number of visitors to the Site and/or providing ATEMP POUR ELLE with a certain number of indicators. These Web Beacons may be used with some of our partners, particularly to measure and improve the effectiveness of the Site. In any case, the information obtained through these Beacons is strictly anonymous and allows only to gather statistics on the traffic of certain pages of the Site to better serve the Clients of our Site.

Article 10 - Miscellaneous Provisions

10.1. Force Majeure

ATEMP POUR ELLE will not be liable for the total or partial non-performance of its obligations under this contract if this non-performance is caused by an event of force majeure, including in the case of disruption or total or partial strike, particularly of postal services and means of transport and/or communication, flood, or fire. The Parties agree to consult each other as soon as possible to determine the modalities for processing the order during the force majeure event. Beyond a period of one (1) month of interruption for a force majeure event, the Parties will be released from their obligations towards each other.

10.2. Entire Agreement

These general terms and conditions of sale and the order summary sent to the Buyer form a contractual whole summarizing all agreements between the Parties.

10.3. Retention and Archiving of Transactions

Invoice archiving is carried out on a reliable and durable medium to correspond to a faithful and durable copy.

10.4. Governing Law – Competent Jurisdictions

These general terms and conditions of sale and the contractual relations between ATEMP POUR ELLE and the Buyer are subject to French law. In the event of a dispute, exclusive jurisdiction is given to the competent French courts. However, ATEMP POUR ELLE agrees to seek an amicable solution before any legal action.
